TERMS AND CONDITIONS: EXPRESSO’S, IN COLLABORATION WITH ABSA,SUMMER CAMPAIGN 2024 COMPETITION

Important clauses which may limit our responsibility, place an obligation on you to indemnify us, involve an acknowledgment of any fact or involve some risk for you will be in bold and italics. You must pay special attention to these clauses.

1. Introduction
1.1. The Expresso’s, in collaboration with Absa, Summer Campaign 2024 (“Campaign”) is organised by Absa Bank Limited, with registration number 1986/004794/06, a public company duly registered and incorporated in accordance with the laws of the Republic of South Africa, with its registered address at 15 Troye Street, Johannesburg, 2001 (“Absa”), and Cardova Trading (Pty) Ltd, with registration number 2010/007686/07, a private company, duly registered and incorporated in accordance with the laws of the Republic of South Africa, with its registered address at No 41 Bell Crescent, Westlake Business Park, Westlake, Cape Town, 7945 (“Cardova”). For purposes of these terms and conditions Absa and Cardova is collectively referred to as the “organisers/we/us/our”.
1.2. Each person entering the Competition (entrants/you/your) agrees and accepts that the Competition rules as set out in these terms and conditions are binding on him/her and acknowledges that he/she has been given enough time to read these terms and conditions before participating in the Competition and that he/she is aware of all the terms printed in bold and italics.
1.3. By participating in the Campaign, participants’ personal information may be transferred to our service providers and agents (including their subcontractors) to store and use as necessary. We will never pass participants’ information to any third party for them to use in their own direct marketing without the participant’s consent.  
1.4. A copy of these rules is available to all entrants and can be downloaded from the www.expressoshow.com/competitions/ website by searching Expresso’s Absa Summer Campaign 2024.
 
2. Competition Period
2.1. Entries for the Competition will open on Monday
2.2. , 25 November 2024 and will close at 12h00 on Friday, 20 December 2024(Competition Period).
 
3. Who can enter
3.1. In order to be eligible to enter the Competition:
3.1.1. you must be a legal, permanent resident or citizen of the Republic of South Africa;
3.1.2. you must be at least 18 (eighteen) years of age;
3.1.3. provide correct and full personal contact details, as required;
3.1.4. you must be a natural person (e.g. not a company, close corporation, trust or other similar legal entity).
3.2. Notwithstanding clause 3.1, you are not eligible to enter this Competition if:
3.2.1. you are a director, member, partner, employee, agent or consultant of the organisers of the Competition, or any other person who directly or indirectly controls or is controlled by the organisers;
3.2.2. you are an immediate family member of any of the persons specified in clause 3.2.1; or
3.2.3. you are a supplier of goods or services in connection with the Competition.
 
4. How to Enter
4.1. Competition posts will be included on the Expresso Facebook, X and Instagram platforms throughout the Competition Period, which posts will include questions (Competition Posts).
4.2. To enter the Competition, you must submit your entry on WhatsApp to0769698448 and include the following:
4.2.1. Your name;
4.2.2. Copy of the relevant Competition Post question that you are answering;
4.2.3. Your answer; and
4.2.4. #mycarddoesthat
4.3. Once you meet the requirements set out in clause 3 above, clause 4 and answer the entry question correctly, you will automatically be entered into the Competition.
4.4. You may enter as many times as you like, provided that each entry is unique (i.e. not the same answer).
4.5. No automated entries will be allowed. Entries must be made manually.
4.6. You are required to attend to the cost for your entry. WhatsApp rates are in accordance with the entrant’s mobile network service provider.
 
5. Competition live call participation
5.1. The organisers will, in their sole discretion, select entries throughout the Competition Period who will be phoned live on the Expresso Show (“live calls”). Selection will be based on the correct answers provided.
5.2. A total of 9 (nine) entrants will be phoned live on the Expresso Show throughout the Competition Period, with the final live call being on
13 December 2024 (unless otherwise determined by the organisers).
5.3. Stand a chance to win your share of R100 000. If the selected entrant answers the live call and answers the 5 (five) questions correctly, which will be asked by the Expresso presenter on the live call, that entrant will be eligible to receive the following cash prizes:
5.3.1. A R5 000 (five thousand rand) cash prize will be awarded to each entrant who participates in the live call;
5.3.2. If the selected entrant is an existing Absa account holder (that is active and in good standing) at the time of the live call, that entrant will receive an additional R1 000 (one thousand rand) cash prize;
5.3.3. A further R 1 000 (one thousand rand) cash prize will be awarded for every question that the selected entrant answers correctly on the live call; and
5.3.4. If the entrant answers all 5 (five) questions correctly on the live call, the entrant will also be awarded a cash prize for the value of the amount in the Vault, which is made up as follows:
5.3.4.1. For the first live call value of the of the Vault will be R1 000 (one thousand rand).
5.4. Shortlisted entrants will be phoned on the number from which the selected entries are sent the day prior to the live call to notify the entrant to be on standby for the live call on the following day and to request information to vet the entrants’ entries. Please note that being contacted as a shortlisted entrant for the live call does not guarantee that you will be phoned to participate in a live call and/or that you will be awarded a prize for this Competition.
5.5. If a selected entrant for any reason does not answer the live call (on the first attempt), the entrant will forfeit the prize and have no claim against us and we shall be entitled to select a different winner at our discretion.
5.6. The winners may be announced on the Expresso television programme, Expresso digital platforms and/or Absa digital platforms.
 
6. Distribution of prizes
6.1. Each entrant who is awarded a prize in terms of this Competition will be required to, within 10 business days of being requested to do so, provide a bank confirmation letter for a South African bank account into which the prize should be paid. The prize will be paid into the aforementioned nominatedbank account within 45(forty-five) business days from the closing of the Competition.
6.2. The prize does not include any other items that are not specifically stated herein.
6.3. The prize is not transferrable and may not be exchanged for any other items.
 
7. General
7.1. We may declare any prize forfeited (lost) and we may choose a new prize winner, if:
7.1.1. a winner’s entry is not valid;
7.1.2. a winner has breached these terms and conditions;
7.1.3. a winner cannot be contacted or does not accept the prize within the agreed time periods; or
7.1.4. a winner, in writing, gives up the prize or we determine in our discretion that the winner has given up the prize.  
7.2. We are notdo not take any responsibility if an entrant’s entry is not successfully submitted or if a winner does not successfully receive or take up a prize for any reason including, but not limited to, a technological failure.
7.3. If the organisers cannot continue with the Competition for any reason beyond its reasonable control or if it is required by any regulatory terms or applicable law, the organisers may end or alter the terms of the Competition on condition that no entrants have qualified for the Competition and reasonable notice has been given beforehand to all entrants. If the campaign is ended as set out in clause 7.3, no entrantwill have any claim of any nature whatsoever against the organisers.
7.4. Amendments to the terms and conditions:
7.4.1. The organisers are entitled to amend the terms and conditions hereof if it is deemed necessary in its sole discretion, and such amendments may relate to any aspect of the Competition.
7.4.2. The amendments may include the addition and/or deletion of any existing and/or proposed terms and conditions of the Competition, and may also affect the prizes herein.
7.4.3. The proposed amendments may be affected before the start date of the Competition and/or during the Competition Period, which amendments may result in the Competition Period being cancelled, reduced, extended and/or suspended as deemed necessary.
7.4.4. It is the entrant’s responsibility to regularly check the website where the Competition rules are made available as per clause 1 for any amendments.
7.4.5. In the event that the terms and conditions of this Competition are amended, such amendments will become effective immediately or on such date as may be determined by the organisers. However, all entrants who have received confirmation of a prize before such amendment will remain eligible to receive the prize that has been awarded to them in accordance with the terms and conditions in force when they were determined as winners.
7.4.6. No entrant will have any recourse or claim against the organisers for any direct or indirect loss or damage as a result of any amendment to these terms and conditions, or as a result of the organisers’ cancellation, termination or suspension of the Competition in line with these terms and conditions.
7.5. The organisers’ decision regarding any matter concerning the Competition and/or arising out of these terms and conditions, including (without limitation) the determination of the winners, is final and no correspondence will be entered into.
7.6. Personal Information
7.6.1. We will process entrants’ personal information to validate their entry and if they are a winner, to make the prize available to them. By entering this campaign, entrants consent to us processing their personal information for this purpose. If they do not consent to us processing their personal information, they should not enter this Competition.
7.6.2. We will only collect, store and use entrants’ personal information, such as their name, age, telephone number and email address for the purposes of participation in the Competition and for administering the Competition. This will not affect any existing marketing preferences that they have registered with Absa.
7.6.3. By participating in the Competition, entrants’ personal information may be transferred to our service providers and agents (including their subcontractors) to store and use as necessary. We will never pass entrants’ information to any third party for them to use in their own direct marketing without the entrants’ consent.  
7.6.4. Entrants’ personal information will be held on record for a period as necessary to administer the Competition, in any event not more than 5 (five) years, and then securely destroyed.

7.7. When a winner accepts their prize, the organisers would appreciate the right to identify the winner by taking their photograph (at no fee) and publishing this in the relevant media as decided by the organisers. The organisers do, however, acknowledge the winner’s right to choose not to be identified and may refuse to have their photograph taken and published in printed media or to appear on radio and television.
7.8. If the winner has given their written consent, the organisers have the right to publish the winner’s name and/or photographs (at no fee) in any advertising, promotional, print, point-of-sale or public relations material. The nature of these publications will be determined at the sole discretion of the organisers, for a period of 12 (twelve) months from the determination of the winner.
7.9. By entering the Competition, the entrant unconditionally and irrevocably indemnifies and holds harmless the organisers, as well as its holding company, its subsidiaries and any subsidiaries of its holding company, and their successors and assigns, directors, employees, agents or consultants against all and any losses, damages and/or injuries howsoever arising from, or in connection with (directly or indirectly), the entrants participation in the Competition and or the use of the prizes. By accepting the prize, the winner accepts the prize at his/her own risk.
7.10. The Competition is in no way sponsored, endorsed or administered by Facebook, Instagram or X and any correspondence related to the Competition should be directed at us and not Facebook, Instagram and orX.
7.11. We may require the entrant to provide a copy of his/her Identity Document,proof of address and bank confirmation letter to enable us to verify the entry.
7.12. We reserve the right to disqualify any entrant suspected of fraud or cheating including without limitation, through the manipulation of code or otherwise falsifying data.
7.13. The Competition and these terms and conditions will be governed by the laws of the Republic of South Africa.
